Surfboard Storage Slot Rental Policy.
The following policy has been adopted by the Board of Directors and applies to all surfboard storage racks/slots owned and rented by the Association.
Eligibility. Surfboard slot rentals are available to current residents on a yearly basis and are non-transferable.
Rental Payment. Surfboard slot rental payment is $60 per year per surfboard, payable one year in advance. A refund will be given if the surfboard slot is given up prior to the end of the year. Checks should be made payable to Marina Towers and made through the Managing Agent’s office.
Key Deposit. A key deposit of $50 will be collected upon acceptance of the rental agreement.
Use. Items must be kept within the confines of the slot(s) and the area kept in a clean, sanitary and relatively neat condition. Only surfboards are allowed in the surfboard storage rack slots. No subleasing allowed.
Risk. The use of the surfboard storage rack slots is at the sole risk of the user; the Association makes no representation, nor assumes any obligation to provide security and/or insurance coverage for the contents of the storage rack and slots. The storage slot renter, their family and/or representatives fully releases and discharges the Association, its employees, agents, and Board of Directors, from all claims for loss, damage, theft, destruction and/or personal injury, regardless of the cause thereof.
Changes. The Association has the right to modify the storage slot rental policy by giving 30 days written notice to the renter of record. Any modifications to the storage slot rental policy must be in writing and mailed or hand delivered to the renter by the Resident Manager or Managing Agent.
Disposal of Surfboards. If the user moves and leaves the surfboard in the rented slot. the surfboard will be removed and disposed of, even if the rent has been paid
Termination. The slot rental can be canceled by providing (10) ten days written notice prior to the termination. At the time of termination, the slot must be cleared of all contents, and the possession and/or control of the slot returned to the Resident Manager. Upon termination of the slot rental for any reason, should the user fail to immediately remove all of the contents, the Association will dispose of any remaining items upon providing (30) thirty days written notice to the user at their last known address, and/or in accordance with applicable Hawaii law.
Agreement. Continued use and payment of the rental fees is understood as full agreement to this policy.
If you currently have a surfboard stored in the Association storage area and do not agree to the above policy, in full, please inform the Resident Manager of your disagreement and he will make arrangements with you remove your surfboard from the storage area.
